Ex-Ferrari employees indicted by Italian court
There is a report on grandprix.com about two former Ferrari employees being indicted in Italy for allegedly "stealing" information belonging to Ferrari to give to Toyota.
http://www.grandprix.com/ns/ns15912.html I know in Australia there is a civil action based on breach of confidentiality, ie. disclosure of confidential information, and there are numerous cases of employees taking information sensitive to the business operations of one employer to another employer, or setting up their own company based upon it. It's interesting that in Italy, this seems to be a prosecution. It might also embroil Ferrari and Toyota, as the article asserts that Toyota is refusing to return the software allegedly based on the information "taken" by the ex-Ferrari men because Toyota has developed it so much that it has become Toyota's software. It also calls to my mind the prosecutions of Sir Frank Williams, Patrick Head and Adrian Newey over the death of Senna, which dragged on for years and, I think, at one stage threatened motorsport events in Italy. This isn't in the same class, though. |

Could take ages though, for someone has to be guilty (assuming this covers all Italian prosecutions).

Think this has been in the courts for a long time already. Weren't we discussing this a few years back, when the Toyota came out looking like a clone of the F2001.

This has been discussed before, about 2,5 years ago.
Back then the Toyota TF103 was allegedly a clone of the F2002 IIRC. Whilst the Sauber C23 was a clone of the F2003, also allegedly ofcourse. |

Difference is, Toyota's design was achieved by inappropriate means.
Now, the issue lie in whether Toyota knew and wanted this, or are they innocent of their employee's acts. But it's quite hard to be ignorant when most people could see the similarities (despite the differences claimed). Not the best way of winning your races, if you ask me. But what to do? It won't surprise me if mid year in 06, we see something familar appearing on Red Bulls... but of course, it's the idea of Newey...not some copied software. |

Ok, and then what ?
Give back software ? Pay millions ? Ex-ferrari's employees in jail ? It makes worth doing that anytime, Toyota seems to be above all that. |

but the Toyota was better than Ferrari last season - theres no way they would want to return the developed data!
