Model release forms?

Have you ever had any problems with people kicking up a fuss after you have published or sold a shot in which they are recognisable for reasons of either use of personal image or payment.

In other areas of photography, photographers often employ a model release form which they ask 'subjects' to sign. Some major magazines also require a model release for shots they publish to avoid legal challenges.

In particular I'm thinking of marshalling, paddock personnel and "public at motorsport event" shots.

Any comments appreciated.

I'm not sure of the situation in the UK but I think if your at a public event like a motorsport race theres no problem at all.

Most marshals moan about never getting in the papers and mags so if you get some of them doing something im sure they would love to see it in print.

It would depend on the usage. If you are going to use the images(s) for editorial use (newspapers, magazines, etc) then you don't need a model release. If you are going to use the image(s) for advertising, promotional, etc then you should have a model release. Some publications do require model releases even if the image is used for editorial. Get a copy of their photo guidelines from them before you submit anything.

There are model release forms online but you should check the wording to insure you are protected according to the laws of your country.

Also you may need a publication release for property. Cars are property of the owner/driver and can be identified with the owner/driver.

One other thing to remember, just because you have a model release doesn't mean they won't ask for money either before or after they sign it. So make sure that the form has a something referring to compensation for use. Compensation could be cash, 8x10 or the fact that they know that their picture could be in a newspaper.
