CAMS CONTINUES WITH TEAM DYNAMIK INQUIRY
The Supreme Court of Victoria this morning rejected Team Dynamik's application for an injunction to delay today's Stewards' inquiry into alleged breach of regulations relating to V8 Supercar testing, confirming that the matter must be dealt with under the CAMS' judicial system. The Supreme Court also ordered that Team Dynamik pay CAMS' costs. The Stewards' inquiry into Team Dynamik's alleged breaches of the regulations relating to testing as set out in the 2004 AVESCO Operations Manual commenced this morning at 10am as scheduled at Sandown International Motor Raceway. Supreme Court Judge Mr Philip Cummins rejected the injunction application on the basis that the parties have voluntarily agreed to a judicial system which is designed to ensure legal technicalities are minimised, and it is premature for the court to intervene, particularly when the proceedings had not even started. Furthermore, it was decided that the material involved in the case is a matter for the experts in the area, being the Stewards appointed to conduct the inquiry. Justice Cummins commented that while there are serious matters involved in this particular case there is nothing in the context of the rules or the case to warrant the court interfering. Confederation of Australian Motor Sport President Mr Colin Osborne said this morning: "CAMS is pleased that the Supreme Court of Victoria has reinforced the sports authority over its own judicial system, and confirmed that all avenues of the CAMS judicial system must be exhausted prior to any party being able to seek the transfer of any matter to the civil law jurisdiction. "All participants pursuant to the rules in the AVESCO Operations Manual agree, through their entry into the Championship, that they will not become a party to any suit at law against the FIA, CAMS or AVESCO or TEGA until all remedies allowed by these rules have been exhausted. "Put simply, participants in all CAMS motor sport agree to abide by CAMS' judicial system prior to entering into a court of law. "This is consistent with the Federation Internationale de l'Automobile's (FIA) International Sporting Code which CAMS, as the sole National Sporting Authority for four wheeled motor sport in Australia, is responsible for regulating." The Stewards inquiry was still in progress at time of release. |

They just had a bit about the story on the news, I'm sick to death of Keiran Wills, or whatever his name is whinging about not having done anything wrong... god, stop insulting everyones intelligence..
And since when were TD sponsored by Dodo, did I miss something at the last round... |

Why do they want to delay it, !/4 of a million is the same now or in 4 weeks time!
Is there a big chance that they are going to pay dearly for this,perhaps on of the few sponsers on the car is ready to walk if associated with a team that is alledged to have cheated and will walk if found guilty, up until the point thay are actually found guilty the sponser would be abliged to pay the monthly sponser commitments and then sue the skeleton if they are to recuop monies payed in good fiath during the awaiting of trial. maybe Brede has an out clause in his payment that allows him out if the team is deemed to have brought his reputaion into question , via "birds of a feather stick together" sort of logic. Gee hasn't Oscar hold some pretty special "shares" in a company for what was assumed at the time a lower pay in exchange for a % of the profits, I am sure is happy that he would be up for a % of the fines and losses in caught. Unless you had already been caught doing pretty much the same thing at Gibbo's, what position he led is unclear but he was employed by 2 teams to have been caught breaking the testing laws, maybe he is the common link. What a Sh*T Fight eh. |

The hearing is still going as I understand it.... I suspect they will stop sometime soon and reconvene at another time... which may have been the upside of the Supreme Court action, even though it didnt succeed as intended.
In any case, Dynamik have not brought the "gold" car to Sandown.... Meantime, the team has secured naming rights sponsorship from dodo internet for the balance of 2004.... So somebody still loves the team.... I was intrigued at the official Holden Motorsport comment in AA suggesting that Holden didnt fund and support Dynamik all that much... confirming a few recently developed suspicions.... Let'em race... if Kelvin is getting his jollies by again sticking a rocket up another team and proving who indeed has the most power, then he is succeeding.. meantime the sport's reputation is tanking.... |

Interesting you mention what sponsors will do. I know one of the sponsors and Team Dynamic is pleeding innocence and that it is just a misunderstanding and there is nothing to worry about.
Its pretty funny how quiet they have kept it from some of their sponsors. I made mention of Dynamic to one of the managers and he had to bring it up with one of the senior managers. Cheers, dave Last edited by zonda; 9 Sep 2004 at 10:13. |

Funny to also see a few teams blantantly unhappy with it all to.. I think it was GRM had a poster up in their shed, something about our products are not tested on... I didn't get the rest of it, it was only shown briefly.. get it up em I wreckon, ping them for every dollar they got.

I was told at the track this morning that the hearing went from 10 am until 8 pm yesterday (Thursday) and was in progress again this morning.
Both TD cars took part in practice 1. |

Just had an interesting thought. With all the talk about how the TD franchise may soon be available for purchase after their little indescrepancy. Could this provide the ideal opportunity for TEGA/AVESCO to reclaim a franchise, and reduce the grid to 33. This would be only one off their magic number of 32. Is it possible for them to be stripped of their franchise as punishment? TEGA/AVESCO could then not make it available again, and hence we're down to only 33.
