Having a discussion with someone the other day... had them asking whether the continual financial crisis is actually a manufactured article. The point of view put forward suggested that if the team keeps crying poor, that they will attract desperation funding, reducing the reliance on the existing sponsor pool and personal funds....

Sounds plausible if the intriciacies of the history arent fully explained....

I guess possible, but a tune likely to grow old with time.

Interesting, the franchise is held in a different company to the ''Team'' also june the 16th will be judgement day, The rat has still not been paid.

Defendant: Team Kiwi Racing Ltd

Applicant: Apparel By Design Ltd
Liquidation application date: 17 September
Hearing date & time: Thursday 28 February at 10am
Adjournment date & time: Associate Judge Sargisson gave Team Kiwi Racing counsel Edwin Telle until 2pm Friday to file further evidence, Apparel By Design counsel Andrew Steele to 4pm Monday to reply, and said she would hear from counsel in court at 11am on Tuesday.
Other details: Team Kiwi Racing, represented by Edwin Telle, applied today to strike out the liquidation application. Mr Telle said it was an abuse of process and flagrant breach of the rules and should be stopped before it caused further damage to this company: “A statutory demand was purportedly served on 16 August. Advertising took place through the media before proceedings were served. The proceeding was served on 26 September.” Although he gabbled the point, Mr Telle told the judge news about this application constituted advertising: “Advertising includes any publicity in the media….. The applicant went to the media and undertook a national campaign against my client. [He had] a letter from a sponsor who’s now pulling out his sponsorship, a $300,000 sponsor.” As I have written in the U column before, news does not constitute advertising. Associate Judge Sargisson didn’t rule on this point but awaits argument on it next week. Mr Telle said the statutory demand was served first time at the wrong street address on Montgomerie Rd, Mangere, and Apparel By Design knew the racing company had vacated the premises and moved to Te Rapa, Hamilton. He said when Team Kiwi Racing did get it the demand period had expired. But Mr Steele said the Mangere premises were still on record as the registered office at the time of service and, in any case, after the process server noted the address error the demand was served to Te Rapa the same day. Mr Steele, standing in for lawyer Natalie Tabb, said he understood “the press were aware of the proceeding. Rather than him (the applicant) publishing it, they were already aware of it….. There was no agreement between the parties that it shouldn’t be advertised. It was up to Mr Telle to bring the matter forward if he wanted urgent relief. The advertising has taken place in a formal way in the period when it was allowed to do so.” Mr John is a director of David John Motorsport Trust Ltd, Numero Uno Investments Ltd, TKNZ Ltd, TKR Automotive Ltd & TKR Events &
Promotions Ltd.

The last few posts are interesting, ans presumably they are sourced from
various legal cases involving the TKR operation, and its various legal entities.

That TKR refute the reporting of the machinations and outcomes of most of these events, ultimately they are an item for discussion, if indeed there is discussion, to state the fullness of the decisions, and not just allow the media to dissect them...

Referencing these would be great also...

I am not convinced that the structure, asset holding and cross shareholdings of the various TKR legal entities is known... which makes some of the text of this difficult to follow.

But if it stays relevant... it isnt strictly speaking breaking any rules...
