Whispers from the powder room over in the land of the long white sheep suggest that there may be movement at the station in the world of the Official Assignee of Mr John.

The powderettes have suggested that there is almost a 7 figure number remaining from the liquidation of the TKR REC thru Numero Uno Ltd, and after the OA-anointed liabilities of that entity have been extinguished, with the balance allegedly to be released to Mr John by the Official Assignee sometime before Bathurst.

What the powderettes are wondering, is whether the claims made all around the place against legal entities other than Numero Uno Ltd (yet are owned/controlled by Mr John), are also to be satisfied by this alleged money.

From memory there was much talk of claims from SBR, Apparel by Design, Mr Radisich, Mr Scott, Mr Gillon, Mr Webber amongst many others... purely allegedly of course amounting to much more than the amount allegedly destined to be returned. Presuming of course there is legal capacity & precedent to do so, has this saga finally played out to its conclusion, or are there more bumps in the rainbow?

If the powder room dwellers are right, and who knows anymore, Mr John may otherwise be assigned a significant personal financial windfall within the week

Presuming any of this actually happened Actually, who really knows any more?

WTF...
The OA only had Australian supplied funds...
from the sale of the REC and a small recovery from the sale of the freightliner transporter repossesed in Aussie some time ago to satisfy her claimants, initially.
With a pitance from assett sales locally.
Have other significant funds been introduced at some point?
As her expenses are extracted from this fund as well, I believe there may well still be a shortfall to satisfy the $ for $ criteria...Although I expect that shortfall may well be covered, in timely fashion, thus allowing Mr. John to continue his scam.
IMHO there is a buck or two available “subject to demand” dependant totally on this bankrupts needs.

Somewhere around $1M was returned from the REC sale. Short of the full $ for $ won't see an annulment. So maybe the declining of claimants and removal of the floater will allow DJ to pull it off. I expect we will hear more "We don't owe anyone" any time soon...IF...what you say is correct.
Mystified as to where any alleged surplus is available to top up Mr. Johns pockets though. Unless some stringent examination has perhaps discovered some previously unknown cache of funds.

Mr. Gillon and ANZ Nat seem to be the only creditors of Mr. John to be in line for full settlement by the OA. Only their full settlement allows for an annulment, right?
And that settlement is damn near a million dollars...Just over a million isn't it!...Then there's the OAs bill...
GTR M give us a hint...Where is the surplus?

Mr. & Mrs. Webber and young Matt...W Webber was noted as Director of NUI...weren't the director/shareholders to be settled cumulatively with the Liquidation of NUI,and inclusive to the bankruptcy of Mr. John?
How much here? another half mil?...

TKRs creditors’...
Most have paused... adopting a "lets wait and see what the OA gets up to" position.
For this bankrupt it’s worked pretty well,as a "buy some time for TKR" this "game".


Mr. Radisich...was mediated out of an alleged half million dollar law suit,and agreed to settle for substantially less, , a year down the track... allegedly...
Paul was rumoured to have allegedly breached Mr. John’s conditions of settlement,
So...its safe to assume he recieved...nothing.

Apparel by Design may have simply gone away.
SBR are still allegedly owed and yet they appear to be still willing to do business with Mr. John, In the interest of receiving some settlement in the future possibly.
IDL may have entered some sort of settlement agreement, similar to the Rats perhaps?
Hard to say......what with these agreements inevitably having "confidentiality clauses” and settlement dates well into the future.

The Scott family interests and others allegedly still owed will have to take their chances with TKR if the OA annuls Mr. Johns personal bankruptcy, Cos if he gets annulled,"they’re off again" eh?

Most unpaid staff, former friends of the team etc seem to have simply vanished.
Not prepared to send any more of their life chasing this tale!

Life goes on...Rough for those who spent and lost.
WHO KNOWS ANYMORE GTR M?...DJ, Mike and the Legals...that’s who!
Like I said a while ago, it’s been well done AS HAVE MANY Kiwis!

Well... I think a little further illumination on Mr John's achievements is called for at this time.
Some time back I was made aware of the appointment, of the “Youngest Executive in Audi Australia's history” and with some fanfare too, I might add.
FURTHERMORE...

David John resigns as Audi GM 20 November, 1997 ...

Mr David John has resigned as general manager of Audi in Australia, effective immediately.
Mr John, who has resigned for personal reasons, assumed responsibility for the management of Audi in Australia on September 1, 1997.
Mr C.K Liew, chief executive of the Astre Automotive Group, which holds the Audi franchise in Australia, said that Audi has accepted Mr John's resignation with regret.
"This is now the second change in management for Audi during the short tenure of the Astre Automotive Group, however I would like to personally assure you that our commitment to build the profile and sales of the Audi marque in Australia remains unchanged," Mr Liew said.

This little tid bit was sent to me by a friend who knows a lot more about the automotive world than most, and suffice to say, he feels we should get to know more about the ExSupercar Icon in NZ.
He went on to say that that the above "young executive" was escorted from the premises of Audi Oz by Police, with the appropriate noises.
How come we are not all aware of this?
A best kept secret if ever there was one IMHO. And an Embarrassment for Audi Aussie...

For one who has been actively pursuing $$$$ to further "the Dreams" of NZs motor racing fraternity, one has to ask...What the hell has been going on here?

OTOH...
Mark Petch Motorsport was established many years ago, as with many other NZ based Entities...No name changes or ructions...Just a continual line of Fair Trading and Goodwill....The NZ way... ... RIGHT!

Are we that gullible here that we were "ripe for the picking” if so ...WHO is going to put this act to rest?
As a dedicated Petrol head...I find it appalling that NO ONE has been fairly treated and yet Mr John continues to proclaim outside parties are trying to discredit and tarnish his name... Hindsight is 20/20, History repeats...
The more I look the more I find that troubles me with regard to this teams dealings...

The Official Assignees efforts and those of others seeking to "clarify" Mr Johns financial movements seem to be met with resistance to "disclosures " by all closely involved...
Its NOT GOOD...not for Sponsorships and NOT for fans of Motorsport in NZ either IMO.
Those "Hot Laps" are still being sold and still not being held either! this months posted [Sold Out] rides were not held...
BUT......as past experience dictates... past purchasers will now be joined by a fresh group who have "lost their money"...

Isn't ANYONE watching this?

"Red" Ross has been taken to task for his "No Show Air Show”, at Hamilton, He’s in Court this week in Hamilton...
Facing Fraud charges relating to some $500K of ticket purchasers money...
The Waikato Times headlined his course...
Why don't the Waikato Times take a look at Mr Johns?
I feel "SOMEONE SHOULD"...Waikato people and others have collectively lost way more than $1/2M...
AND Mr Ross hasn't done the company "speedy scene shifting "that appears to have been vigorously pursued by Mr John
historically...
As usual, those "scammed folk" get to be wiser after the event and turn their backs on Motorsport and move on ...
Leaving Mr John to continue his act....UNCHALLENGED...
Now is the right time to complain...This is an issue of public interest...and as such the Official assignee SHOULD appoint someone to take a deeper look...

All fraud perpetuated by complex means.

More raw meat from the balcony...


Another… “New to the Dream”…A possible sponsor…Won an auction at TKRs pre Bathurst Dinner at the Hyatt Hotel in 2007.
The year TKR had to leave Auckland for greener pastures…they had pugged up the paddock... no easy tucker left there. Time to mooove on…to the WAIKATO…
Not only did he find Ross Stones [quest speaker for the do] speech and reminiscences of the Stone Bros history, a trip down memory lane, enthralling…he remembered the Onewhero mobs early racing days himself…as most NZs Motorsport fans of that era do…He was convinced, as most are, that if anyone of Ross’s caliber is involved then everything must be on the upper… [Disregarding “gossip” surrounding the dream]…floating around at the time…
The prize? A helicopter pickup for the winner for two…to Puke…AND…Hot Laps for two …the usually promised certificates…snack and nibbles and delivery back home…So…after some spirited bidding he was the happy winner of this prize.
Inevitably he paid for his purchase…By Credit card…Eftpos...Well…Can you imagine his surprise a week or so latter when he found his Visa statement had been billed twice. Invariably he contacted our team to be told no worries mate just been experiencing so technical problems with the Eftpos machine…will put this right immediately…well…a week or so later and still no correction…so he contacts an officer of the team…And gets yelled at …Not impressed …however it seems that a friend of the team now gets involved and loans DJ the appropriate amount to deposit in our purchasers bank account…thus reimbursing the ‘double dip’…Problem solved you would think…NO NOT REALLY…You see, all these years later he still has not received his Rides…So he is still out of pocket for the purchase…AND…DJ has not returned the originally spent funds…Although over the years he has been reassured several times that his rides are imminent…YEAH RIGHT!..
This person now knows …he has met others who have experienced these “technical glitches “when their Visas were Eftpos malfunctioned…He aint gunna get squat!
So what…Some say…? So, he’s not alone in this I say…there are many more where that came from! ONLY the Eftpos player and the bank doing these transactions have records of these occurrences…and neither is saying anything about these events…that confidentiality thing working its magic eh!

Now harking back to the transporter driver who drove the unregistered Freightliner last year, I may have their story to tell later…

Please tell us the story about the transporter driver Mr opinion8head. I know an ex TKR transporter driver. The stories he tells me aren't good. Something about being very 'out of pocket.'

Well Road Train…I don’t know which Driver you refer to…Specifically…

Was it the one who left reputedly over $100K of his life’s savings in Mr. Johns care…?
To be reimbursed “later” when “things come right”? He wound up with a trespass order served against him for [being a nuisance]… “Requesting reimbursement”
Or the one who spent over $30K on another soul’s credit card in pursuit of the team’s aims…?
And suffered huge guilt when he realized what had just been done?

Or was it the guy who built the Hamilton facility…the one who was bullied by Mr. John into “making a commitment to the team”…Quit his job…went to Aussie with his credit card and spent his ands his wife’s savings on “helping the team”…and who came home broke to find that Mr. John wouldn’t [couldn’t] reimburse him for expenditures on the teams behalf?

Or is it one of the many Aussie “helpers” who under the same “arrangement” found that once they had “covered expenses” for “the team” it was not possible for them to obtain reimbursements on their expenditures either?

I don’t want to sound like Mr. John, but you may have to be more “specific”

Something I have heard repeatedly is the style of Mr. John in these “instances”…These folk present their accounts …Mr. John disallows parts of their “expenditure”… requires original accounts and statements for…“verification by Mike”[the bean counter/accomplice] to allow full payment of a “settlement amount”… these original statements allow… credits for Gst claims and tax refunds… perhaps…

Also …unknown by most…if you wish to get a “legal challenge” started you… MUST PRESENT THE ORIGINAL STATEMENTS…! That takes care of that Eh?

Then once all this hoo haa has been gone through…they wait…and find their cheque for settlement has been “marked down” to 60% of their spending…this cheque usually bounces…and the follow up cheque …usually for around 40% mostly gets honored...somewhere down the track...
By now the ones I know are usually going through such financial stress and turmoil that they have found new jobs and they don’t come back for more… ... It’s a further waste of time!

PAYMENT SCHEDULES…
…. I gather that these “payment schedules” are urged to be agreed on…”ASAP”… BEFORE... any payment on... LONG OVERDUE...accounts, can be made…
Inevitably… the terms of these “settlements” preclude payment until some time in the future…along with other “conditions”…
Hence Mr. John can claim that “settlement” has been reached… this infers the account is paid…
Thus... Mr. John may continue to espouse, he doesn’t owe anyone… EASY Eh..?
Consistently...NO ONE gets paid... UNLESS...? Remember the credit card used to get Deans car out onto the track in Hamilton this year..? Paul Morris had leverage...
.
Now… how about you tell me of your “heard on the road” rumblings…

For all of the bad stories you write/quote it is just hard to believe sooooo many people gave sooooo much without following any sort of business sense. If Mr John had such a bad payment history why did people keep putting themselves in a position to not get paid????

Business is business and you must go into it with your eyes wide open, and if a guy has bad payment history ....well it just doesn't make sense to me .

You also quote alot of transporter drivers, not sure the team ever had that many in its history?

You may just be onto it with your statement of Mr. John walking with a pocketful of $$$...
A little bird told me that a considerable windfall has reportedly arrived at the OAs office…Somewhere in excess of $190K has been “found” to top up " Mr. Johns contributions” towards annulment…
Good news for those in line for payment…
No change of course for those creditors still left out in the cold however… Those not “in the loop”
My source has just a tad under $300K now at hand to assist the “situation”…As I indicated earlier…
”funds are available, subject to demand”.
Dependent on the big guys’ requirements…Not to pay accounts… But to allow him to prevail in his endeavors!

For all those unpaid creditors of TKR…This means nothing for you…no change there…
It does prove one thing though…If you’re gunna do the nasty on creditors…
DO IT BIG!
With the right type of representation [misrepresentation] you may “get away with it” That’s how it looks to me!

On the subject of “doing creditors” anyone want to know about the Eftpos trickery?

CHALLENGED...TKR has a lot of history...Used up a lot of good folk...wherever and however they could...Anyone who could did everything they could,including driving unlicensed...to help the "team"
Business sense...This is MOTOR RACING...More passion than sense! DJ didn't want followers with sense! He wanted their MONEY!...and HE GOT IT!

Wasn't always that way, I ran the team for 5 years and during that time everyone (including myself) was always paid, not always exactly on time but always paid. And like I said earlier, when people knew the nature of the beast why did they jump in. Passion or not I just don't understand why people would put themselves in that position.

Not being deeply involved in motorsport...[perfect marks/candidates it appears]
What happens here is almost beyond belief...ALMOST...but it DOES HAPPEN...and NO ONE is exempt from it...NO ONE!
ARE THEY?...and it continues...
People put themselves in this position ?...Spending on the dream...purchasing...Rides...Merchandise...
They are well charmed or cajoled...IMO.
Most wake up too late...

I have been very open about why I left. I decided the team could do no better with the funding they had and I didn't want to just keep grinding away for the sake of it. We had some great results for the money we had to operate with, 3rd in China, pole at Winton and always knocking on the door of the top ten at Bathurst plus a few NZ Championships along the way.

given that David John is involved in some way with two of the eight minis you are responsible for managing this season, I am not at all sure that you are not just playing politics with your posts, under CHALLENGED.

You and I had several discussions over Mr Johns 'ethics' etc. and my memory says you sang a different tune back then.

I do think "Opinionated" should get over his beef, but hey unlike you, he and his wife did not get repaid, so I guess he is entitled to be p---d.

Hi Mark,

I am not playing politics (don't play games), just don't understand why people have gotten themselves in the positions they say they have finacially with DJ. Some of the figures I hear are huge and if I were putting my hard earned money forward it would only be in a water tight deal. If people are owed money they should be paid but why keep a forum active over this topic?
And just for the record anything I have said to you or anyone else about TKR I would say to DJ directly (and did many times during the years!).

Martin...I too have had many conversations with DJ directly...Haven't recieved anything but contempt!..and LIES!
...and more than a couple of DISHONOURED CHEQUES!...and a quite a few..."Personal iron clad Garantees"...for next week,month..etc etc etc!
for DJ...its just a game...the Winner takes all!...
Ask yourself...where has all this "fresh coin" to the OA come from?

We got conned,and so did all of our friends...DJ went through all he could while he was here...then SHOT THROUGH...
No change there!...TKR's STYLE...Ask FORD AUSTRALIA,FORD NZ,ANZ,Bernie...everyone who has... "experienced the act"...

Sorry to hear about what happened to you.

Here in the USA we put people in jail for writing hot checks. Sounds like the NZ legal system needs to grow a pair.

At some point you have to weigh the time and money invested in trying to recover your funds versus the possible end result. If you continue the fight on principle then kudos to you.

An American associate of mine paid a hefty deposit to do some rallying in New Zealand and the team/driver took his money then never delivered. From what I understand trying to recover the funds is too time consuming for my friend and AFAIK isn't going to pursue it further as the NZ driver/team in question has "disappeared" from the scene. That's his choice but myself would probably chase you down to the ends of earth. It was nothing but pure theft. Unfortunate those types of people are involved in motorsport.

Feel free to name and shame said team. There are plenty of people who wander past here that are involved in all motorsport in some shape or form.

Blueblood, not many Americans have contested NZRC.
not many people win the NZRC, and not come back to defend the title unless they move on to bigger things, this one didn't.

Apparently it was Sam Murray and it involved a five figure sum of a deposit of which the services were never rendered nor the deposit returned.

Unfortunately, I believe it was Ken Block that had recommended Murray to my friend. There was no interest in running the full championship, but I think my friend was just looking for some international experience. Ken Block has done a few rounds himself down there.

Yeah mountainstar…

The yanks and rebs are pretty on to it when it comes to fraud…
They take a more direct approach when a financial system fails… the citizens have Rights.
A couple of decades ago …the dream would not have made it here…
A bit different over here now though…criminals rights and such…

I think he knows what he is doing/has done is wrong…But like they say, it starts small and if left uncorrected just escalates…After pushing over all these folk he is convinced he has the right to act as he does…No one has demonstrated otherwise Eh?
